§ 319: Freedom of the press

Everyone has the urge to state his opinion. The press reaches further than spoken speech, but it is less lively.

How do you secure this freedom?

Directly through laws that prevent or punish excesses. Indirectly by making free speech harmless. A rational constitution, a firm government and public assemblies of the estates achieve this. There educated insight speaks out. Little of importance remains for the others to say. And shallow, malicious talk soon sinks into indifference and contempt.

What is freedom of the press not?

It is not the freedom to say and write whatever you want. That would be like saying freedom means doing whatever you want. Such talk belongs to uneducated crudeness.

Why is this so hard to regulate?

Words are fleeting and have many meanings. You can hint, say half, hide. So the laws here are vague. And the judgment becomes subjective. But one thing remains. Defamation and vilification are crimes or offenses. So is mockery of the government, the prince and the laws. So is a call to revolt.

How dangerous is a word?

That depends on the ground where it falls. A spark on a powder keg acts differently than a spark on solid earth. Science speaks openly and clearly. It does not belong to mere opinion.

Summary: Freedom of the press does not mean you may say everything. Laws and a firm order secure it. How dangerous a word is depends on the ground where it falls.
