Hegel holds research into legal history to be meritorious and necessary \u2013 and the assertion that it can answer the question of what law is valid to be a category mistake. His sharpest sentences are aimed not at Savigny but at his less cautious fellow campaigners.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-large-font-size\">The dispute<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In 1814 Friedrich Carl von Savigny had written against a German civil code in <em>Vom Beruf unsrer Zeit f\u00fcr Gesetzgebung und Rechtswissenschaft<\/em>: law grows out of the spirit of a people, it is not made; the age lacks the vocation for codification. Seven years later the <em>Groundlines<\/em> appear. They return to the question in <a href=\"https:\/\/grundlinien.de\/en\/211\/\">\u00a7 211<\/a> and answer it in a single sentence:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">To deny to a cultivated nation, or to the legal profession within it, the capacity to make a code of laws \u2026 would be one of the greatest insults that could be offered to a nation or to that profession.<\/p>\n<cite>Groundlines, <a href=\"https:\/\/grundlinien.de\/en\/211\/\">\u00a7 211<\/a> note<\/cite><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The clause Hegel inserts in the middle is the actual argument: it is not a matter of inventing <em>new<\/em> laws at all, but of \u201ecognizing the existing legal content in its determinate universality, that is, of grasping it <em>thinkingly<\/em>\u201c. For him codification is no break with tradition, but its comprehension.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-large-font-size\">Against customary law as a value in itself<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">He takes the Romantic elevation of the unwritten apart by taking it at its word. Customary rights, he says, are thoughts just as laws are \u2013 only more poorly known:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Their difference from laws consists only in this: that they are known in a subjective and contingent manner, and are therefore more indeterminate in themselves \u2026 and, besides, the knowledge of the right, in this respect and that, is generally the contingent property of a few.<\/p>\n<cite>Groundlines, <a href=\"https:\/\/grundlinien.de\/en\/211\/\">\u00a7 211<\/a> note<\/cite><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And the claim that customary law has \u201epassed over into life\u201c he settles with a parenthesis in which one can hear the lecture hall laugh: one speaks \u201enowadays, incidentally, \u2026 most of <em>life<\/em> and of <em>passing over into life<\/em> precisely where one is versed in the deadest material and the deadest thoughts\u201c. His example is English case law, in which the judges \u201econtinually act as <em>legislators<\/em>\u201c.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-large-font-size\">The real opponent: Gustav Hugo<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The longest and most biting passage stands already in <a href=\"https:\/\/grundlinien.de\/en\/3\/\">\u00a7 3<\/a> note and is directed against Gustav Hugo\u2019s <em>Textbook of the History of Roman Law<\/em>. Hugo had disposed of the philosopher Favorinus, who had criticised the Twelve Tables, with the remark that he had simply not <em>understood<\/em> them. Hegel picks out the law at issue: the creditors\u2019 right to kill the debtor or to cut him into pieces, with the clause that cutting off too much or too little should carry no legal consequence \u2013 \u201ea clause which would have benefited <em>Shakespeare\u2019s Shylock<\/em> in the <em>Merchant of Venice<\/em> and would have been most gratefully accepted by him\u201c.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">What Mr. <em>Hugo<\/em> means by saying that Favorinus did not <em>understand<\/em> the law is not apparent; any schoolboy is capable of understanding it \u2026 \u2013 by <em>understanding<\/em>, Mr. Hugo must only mean that cultivation of the understanding which is satisfied with a <em>good reason<\/em> in the face of such a law.<\/p>\n<cite>Groundlines, <a href=\"https:\/\/grundlinien.de\/en\/3\/\">\u00a7 3<\/a> note<\/cite><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This is more than polemic. Hegel is naming a procedure which he calls \u201ethe immortal fraud of the method of the understanding\u201c: to give a good reason for a bad cause and to believe one has thereby justified it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-large-font-size\">What he concedes to the historical school<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">More than one expects. In <a href=\"https:\/\/grundlinien.de\/en\/3\/\">\u00a7 3<\/a> note he expressly credits Montesquieu with \u201ethe true historical view and the genuinely philosophical standpoint\u201c: laws are not to be considered in isolation but as a moment of a totality. And purely historical research \u201ehas its merit and value within its own sphere\u201c. The reservation concerns the boundary alone: so long as explanation from historical grounds \u201edoes not confuse itself with development from the concept\u201c.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The famous sentence from <a href=\"https:\/\/grundlinien.de\/en\/3\/\">\u00a7 3<\/a> note about positive right is likewise gladly turned against him and yet comes from him: that \u201eforce and tyranny can be an element of positive right\u201c. That is no justification of what exists. It is the observation that validity and rightness are two different things \u2013 precisely the distinction that the historical school levelled out.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-large-font-size\">How it turned out<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In practice Savigny won: the German civil code came only in 1900, and the historical school dominated the century in between. In substance Hegel\u2019s objection has held.
