{"id":4741,"date":"2021-12-01T10:32:40","date_gmt":"2021-12-01T09:32:40","guid":{"rendered":"https:\/\/grundlinien.de\/?p=4741"},"modified":"2026-08-22T21:41:36","modified_gmt":"2026-08-22T19:41:36","slug":"75","status":"publish","type":"post","link":"https:\/\/grundlinien.de\/en\/75\/","title":{"rendered":"75"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Since the two contracting parties relate to one another as <em>immediate<\/em>, self-subsistent persons, contract proceeds: &alpha;) from <em>arbitrary will<\/em>; &beta;) the identical will that comes into determinate being through the contract is only <em>one posited by them<\/em>, and hence only <em>common<\/em>, not universal in and for itself; &gamma;) the object of the contract is <em>a single external thing<\/em>, for only such a thing is subject to their mere arbitrary will to alienate it (<a href=\"https:\/\/grundlinien.de\/en\/65\/\">&sect; 65<\/a> ff.).<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>The concept of contract cannot, therefore, subsume <em>marriage<\/em> under it; this subsumption is put forward, in its &mdash; one must say &mdash; disgracefulness, by <em>Kant<\/em> (<em>Metaphysical First Principles of the Doctrine of Right<\/em>, pp. 106 ff.). &mdash; Just as little does the nature of the <em>state<\/em> lie in a contractual relation, whether the state be taken as a contract of all with all, or as a contract of all these with the prince and the government. &mdash; The intrusion of this, as well as of the relations of private property in general, into the relation of the state has produced the greatest confusions in constitutional law and in actuality.
