Daß Ich etwas in meiner selbst äußeren Gewalt habe, macht den Besitz aus, so wie die besondere Seite, daß Ich etwas aus natürlichem Bedürfnisse, Triebe und der Willkür zu dem Meinigen mache, das besondere Interesse des Besitzes ist. Die Seite aber, daß Ich als freier Wille mir im Besitze gegenständlich und hiermit auch erst wirklicher Wille bin, macht das Wahrhafte und Rechtliche darin, die Bestimmung des Eigentums aus.
Eigentum zu haben, erscheint in Rücksicht auf das Bedürfnis, indem dieses zum Ersten gemacht wird, als Mittel; die wahrhafte Stellung aber ist, daß vom Standpunkte der Freiheit aus das Eigentum, als das erste Dasein derselben, wesentlicher Zweck für sich ist.
To have power over a thing ab extra constitutes possession. The
particular aspect of the matter, the fact that I make something my
own as a result of my natural need, impulse, and caprice, is the
particular interest satisfied by possession. But I as free will am an
object to myself in what I possess and thereby also for the first time
am an actual will, and this is the aspect which constitutes the category
of property, the true and right factor in possession.
