Im Vertrage erwerbe ich ein Eigentum um der besonderen Beschaffenheit der Sache willen und zugleich nach ihrer inneren Allgemeinheit teils nach dem Werte, teils als aus dem Eigentum des anderen. Durch die Willkür des anderen kann mir ein falscher Schein hierüber vorgebracht werden, so daß es mit dem Vertrage als beiderseitiger freier Einwilligung des Tausches über diese Sache, nach ihrer unmittelbaren Einzelheit, seine Richtigkeit hat, aber die Seite des an sich seienden Allgemeinen darin fehlt. In contract I acquire a property for the sake of its particular
characteristics, and at the same time my acquisition of it is governed
by the inner universality which it possesses partly in respect of its
value and partly because it has been the property of another. If the
other likes, a false disguise may be given to the thing I acquire, so that
the contract is right enough so far as it is an exchange, voluntary on
both sides, of this thing in its immediacy and uniqueness, but still the
aspect of implicit universality is lacking. (Here we have an infinite
judgment expressed positively or as a tautology.)
