Zweiter Abschnitt. Der Vertrag
Das Eigentum, von dem die Seite des Daseins oder der Äußerlichkeit nicht mehr nur eine Sache ist, sondern das Moment eines (und hiermit anderen) Willens in sich enthält, kommt durch den Vertrag zustande – als den Prozeß, in welchem der Widerspruch, daß Ich für mich seiender, den anderen Willen ausschließender Eigentümer insofern bin und bleibe, als Ich in einem mit dem anderen identischen Willen aufhöre, Eigentümer zu sein, sich darstellt und vermittelt.
ii Contract
CONTRACT brings into existence the property whose external side,
its side as an existent, is no longer a mere ‘thing’ but contains the
moment of a will (and consequently the will of a second person also).
Contract is the process in which there is revealed and mediated the
contradiction that I am and remain the independent owner of
something from which I exclude the will of another only in so far as
in identifying my will with the will of another I cease to be an owner.
