Die dem Besitze gegebene Form und das Zeichen sind selbst äußerliche Umstände, ohne die subjektive Gegenwart des Willens, die allein deren Bedeutung und Wert ausmacht. Diese Gegenwart aber, die der Gebrauch, Benutzung oder sonstiges Äußern des Willens ist, fällt in die Zeit, in Rücksicht welcher die Objektivität die Fortdauer dieses Äußerns ist. Ohne diese wird die Sache, als von der Wirklichkeit des Willens und Besitzes verlassen, herrenlos; Ich verliere oder erwerbe daher Eigentum durch Verjährung.

The form given to a possession and its mark are themselves
externalities but for the subjective presence of the will which alone
constitutes the meaning and value of externalities. This presence,
however, which is use, employment, or some other mode in which
the will expresses itself, is an event in time, and what is objective in
time is the continuance of this expression of the will. Without this the
thing becomes a res nullius, because it has been deprived of the
actuality of the will and possession. Therefore I gain or lose
possession of property through prescription.
