B. The Administration of Justice

The relative [character] of the reciprocal relation of needs and of labour for them has, at first, its reflection into itself in infinite personality in general — in abstract right. But it is this sphere of the relative, as culture, itself, which gives to right its existence: to be universally recognized, known, and willed, and, mediated through this being-known and being-willed, to have validity and objective actuality.

It belongs to culture, to thought as the consciousness of the individual in the form of universality, that I be conceived as a universal person, in which respect all are identical. The human being counts, thus, because he is a human being, not because he is a Jew, Catholic, Protestant, German, Italian, and so on. This consciousness, to which thought counts, is of infinite importance — deficient only when it fixes itself, say, as cosmopolitanism, in opposition to concrete life in the state.

    On the one hand, it is through the system of particularity that right becomes externally necessary as a protection for particularity. Even though it comes from the concept, it enters into existence only because it is useful for needs. In order to have the thought of right, one must be educated to thinking and no longer linger in the merely sensuous; one must fit objects to the form of universality and likewise, in one’s willing, direct oneself according to something universal. Only after human beings have invented for themselves manifold needs, and the acquisition of these interlocks with their satisfaction, are laws able to form themselves.
