Der erste Zwang als Gewalt von dem Freien ausgeübt, welche das Dasein der Freiheit in seinem konkreten Sinne, das Recht als Recht verletzt, ist Verbrechen, – ein negativ-unendliches Urteil in seinem vollständigen Sinne (siehe meine 181 Logik, Bd. II, S. 99 ), durch welches nicht nur das Besondere, die Subsumtion einer Sache unter meinen Willen (§ 85), sondern zugleich das Allgemeine, Unendliche im Prädikate des Meinigen, die Rechtsfähigkeit, und zwar ohne die Vermittlung meiner Meinung (wie im Betrug; § 88) ebenso gegen diese negiert wird, – die Sphäre des peinlichen Rechts.

The initial act of coercion as an exercise of force by the free agent,
an exercise of force which infringes the existence of freedom in its
concrete sense, infringes the right as right, is crime — a negatively
infinite judgment in its full sense, whereby not only the particular (i.e.
the subsumption under my will of a single thing — See §85) is
negated, but also the universality and infinity in the predicate ‘mine’
(i.e. my capacity for rights). Here the negation does not come about
with the co-operation of my thinking (as it does in fraud — see §88)
but in defiance of it. This is the sphere of criminal law.
