The subjective side — namely, that this particular individual, out of the several individuals there necessarily and indeterminately are (since the objective element here does not lie in genius, as it does, for example, in art), among whom preference is not something absolutely determinable, is chosen and appointed to a given office and authorized to conduct the business of the public — this connection of the individual with the office, as two sides that are always, in themselves, contingent in relation to each other, pertains to the power of the crown, as the decisive and sovereign power of the state.

    § 292: The Appointment

    For an office there are usually several capable people. With an official, it is not as with an artist, whose talent is unique.

    Who decides then?

    We cannot calculate exactly which of the capable people to take. The link between person and office always remains somewhat a matter of chance. So the power of the crown appoints the official. It is the deciding and sovereign power.

    Summary: There are always several suitable people for an office. We cannot derive the choice among them. So the power of the crown appoints the officials.
